1. Acceptance of Terms

By accessing or using Wall of Trust ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any changes.

2. Description of Service

Wall of Trust is a testimonial collection and display platform that allows businesses to collect customer testimonials (text and video) and display them on their websites through embeddable widgets. The Service includes collection pages, testimonial management tools, and display widgets.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Keep your password secure and confidential
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this requirement.

4. Subscription Plans and Payment

4.1 Free and Paid Plans

The Service offers both free and paid subscription plans. Free plans have limitations on features and usage. Paid plans offer additional features and higher limits as described on our pricing page.

4.2 Billing

Paid subscriptions are billed on a monthly or annual basis, depending on your selection. Payment is processed through PayPal. By subscribing, you authorize us to charge your PayPal account for the applicable fees.

4.3 Cancellation and Refunds

You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide refunds for partial months or unused time.

4.4 Price Changes

We reserve the right to change our prices. We will provide at least 30 days notice before any price increase takes effect for existing subscribers.

5. User Content

5.1 Your Content

You retain ownership of all content you submit to the Service, including testimonials, logos, and branding materials ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of providing the Service.

5.2 Testimonial Content

Testimonials submitted through your collection pages are owned by you. You are responsible for obtaining any necessary consents from individuals who submit testimonials before publicly displaying their content.

5.3 Prohibited Content

You agree not to submit, upload, or display content that:

  • Is false, misleading, or fraudulent
  • Infringes on intellectual property rights of others
  • Contains malware, viruses, or harmful code
  • Is defamatory, obscene, or otherwise objectionable
  • Violates any applicable laws or regulations
  • Impersonates another person or entity
  • Contains personal information of others without their consent

6. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems or software to extract data from the Service
  • Resell or redistribute the Service without authorization
  • Create fake testimonials or manipulate ratings
  • Use the Service to send spam or unsolicited communications
  • Circumvent any usage limits or restrictions

7. Intellectual Property

The Service, including its design, features, and content (excluding User Content), is owned by Wall of Trust and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from our Service without our written permission.

8. Third-Party Services

The Service may integrate with third-party services (e.g., PayPal, Supabase, Cloudflare). Your use of these services is subject to their respective terms and policies. We are not responsible for the practices or content of third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WALL OF TRUST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Wall of Trust and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

You may terminate your account at any time by contacting us or using the account deletion feature. Upon account deletion, your data will be removed in accordance with our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Wall of Trust operates, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with applicable arbitration rules.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wall of Trust regarding the Service and supersede any prior agreements.
